This website is owned and operated by Spinnaker Consulting Ltd (“Spinnaker”) and is made available to you on the following terms and conditions. By using this site and the services available on it you are deemed to accept these terms and conditions and any other terms and conditions and policies published on the site.

Our use of your CV and email addresses is governed by our Privacy Policy and Work Seeker Terms & Conditions.

Use of this site
The information and services available on this site are provided for the sole purpose of assisting individuals looking for jobs and career information and assisting employers looking for staff. You may use, print and download information from the site for these purposes only and for no other personal or commercial purpose. You may not otherwise copy, reproduce, display, publish, transmit or distribute any material from the site without written permission from Spinnaker.

Advice
The publication of information on this site is for information only and does not constitute advice. You should seek independent legal advice before relying on any such information.

Vacancy Advertisements
The site displays two types of vacancy advertisements: 1. Those which are being handled by Spinnaker’s recruitment consultants; and, 2. Those which are being advertised directly by hiring companies. The latter are produced and provided by hiring companies and their agents and are not reviewed by Spinnaker. We accept no responsibility or liability for the contents of such advertisements. You should carry out such verification procedures as are prudent. If you consider any vacancy or other information contained on the site to be illegal, discriminatory or otherwise offensive, please bring it to our attention as quickly as possible whereupon we shall investigate and remove the material as appropriate.

Service Availability and Liability
This site is made available without any guarantees or warranties. Whilst we try to ensure that the content of the site is correct we are not responsible if it is not correct.

We will not be liable for loss of business, loss of revenue, loss of profits, loss of opportunity, loss of anticipated savings, wasted expenditure or any damages or losses howsoever arising including from negligence, delay or unavailability of the site / interruptions to the service.

We may change these terms or alter the design, content, functionality and specification of the site at any time.

Communication
Any communication from us to you may be sent electronically to an email address provided by you to us and shall be deemed received by you on transmission by us unless we receive notification by email within 24 hours of transmission to the effect that such email address does not exist or the email is otherwise undeliverable in which case we may use a postal address or fax number you have provided and in any event may cancel your registration.

Law and Jurisdiction
These terms and conditions are governed by English law. Any disputes will be decided by the English courts who shall have exclusive jurisdiction.

 

PRIVACY POLICY

Use of Your Work Email Address
If you register using a company email address, please ensure that it is secure (i.e. you know who is able to view your inbox). We cannot accept responsibility if your emails are read by colleagues or superiors at work. If your email address is not secure, we would recommend that you obtain a free email address from http://www.hotmail.com or http://www.yahoo.com.

Confidentiality
We understand the importance of maintaining your confidentiality; we will respect your privacy and will comply with our obligations under Data Protection and Employment Agency legislation.

Who Can View Your CV?
When you complete your shippingjobs registration form and send us your CV they will be stored and made available offline to Spinnaker’s consultants only. They will only be forwarded to hiring companies only in accordance with your instructions. For further details, see our Work Seekers’ Terms & Conditions.

What Vacancy Information Will You Receive?
Vacancies which match the profile you create when filling in our registration form may be sent to you by our staff. Vacancies which match the searches you set up on shippingjobs-by-email will be sent to you au tom atically. You can choose to apply to or to ignore any vacancy sent to you.

Your Shippingjobs-by-Email Password
The password you choose when signing up for shippingjobs-by-email is confidential to you alone and is not made available to Spinnaker staff.

You Want to Stop Receiving shippingjobs-by-email
You will only receive jobs from our au tom ated shippingjobs-by-email service if you have set up a password account and saved vacancy searches. You can remove searches and stop receiving the au tom ated service by logging into shippingjobs-by-email using your password and then closing your searches.

You Want to Stop Receiving Jobs From Our Staff
You will only receive jobs directly from our staff if you have completed our registration form and registered with Spinnaker as a Work Seeker. If you are no longer looking for work and you are also not interested in hearing of new vacancies, please email us asking to be made inactive, using mail@shippingjobs.com. So that we can identify you, please give us your full name and either the registration number we gave you or your date of birth.

Registration details
Contact and other details you supply as part of the registration process are stored by us and used to provide you with the information you have requested.

Completing Spinnaker’s Registration Form
You should be realistic about the personal profile you create when completing the lists of skills, experience and qualifications. We will then only send you details of vacancies that broadly match your personal profile. We cannot be held responsible for sending you the wrong types of vacancy if your personal profile is too broad.

Use of Data Held by Spinnaker
Spinnaker may use collected data to identify and publish employment trends such as salary averages and industry demographics. This information will not be capable of being linked to any personally identifying information about users.

Some of our cus tom ers are located in countries outside the European Economic Area.

Removal of Your CV From Our Database
Please note that Spinnaker reserves the right not to register you on our database and to remove from our database CVs which include any content that we consider to be illegal or offensive or factually incorrect. We will also remove your details / CV if a complaint is upheld which has been made against them or if you use rude or inappropriate behaviour towards any member of our staff.

Cookies
Cookies are small pieces of information stored by us on your computer which enable us to identify your computer when you re-access shippingjobs-by-email. The cookies we use also protect the integrity of registered user names and passwords. There is no personally identifiable information held on cookies.

You have the option to decline or accept these cookies.

Statistical information
We provide aggregate statistical information about site visitors and users such as the number of CVs on our database and the number of visitors to the site. We provide this information to hiring companies, advertisers, suppliers and other reputable third parties. This will not include any information that enables them to identify individuals.

 

WORK SEEKER TERMS AND CONDITIONS

These are the terms and conditions which apply between Spinnaker Consulting Ltd, any of its associated, affiliated or joint venture companies, organisations or websites including Enigma International Resourcing Pty Ltd (together “Spinnaker”) and work seekers (“you”) making use of its services. These terms and conditions are supplemented by Spinnaker’s Privacy Policy and Website Use Terms and Conditions, (see www.shippingjobs.com). References to the EAA are to the Conduct of Employment Agencies and Employment Businesses Regulations 2003.

  1. Spinnaker will provide you with work finding services as defined in the EAA. Spinnaker will not charge you any fees for work finding services.

  2. Spinnaker do not guarantee to find you work. We will register you in our database if you have sent us your CV and completed our registration form on shippingjobs.com and you will be included in all searches that we conduct for vacancies we are handling. If you appear suitable for a particular vacancy, our consultants will endeavour to contact you by phone or in writing to confirm your suitability and to invite you to apply.

  3. Your details will not be forwarded to any third party including our employer clients unless you specifically tell us we can do so. By applying for an individual vacancy you are authorising us to forward your CV to the hiring company for that vacancy. Please give us clear instructions when applying for individual vacancies if you wish to discuss them further with us before we send your CV.

  4. By applying for a vacancy which contains an “…@apply-direct.com” email address or a hiring company’s direct contact details, you are applying directly to the hiring company for the vacancy in question. The hiring company, and not Spinnaker, is responsible for responding to your application.

  5. The work finding services Spinnaker provide are:
  • finding / seeking to find you work as explained above
  • the provision of vacancy and other information on our website shippingjobs.com and any other website Spinnaker may operate / utilise
  • the provision of vacancy and other information via our jobs by email service.
  • the provision of vacancy and other information via our e-newsletter ‘Changing Course’
  1. Spinnaker operate as an employment agency in respect of finding you permanent or temporary employment or seeking to find you such employment within the markets in which Spinnaker operate.

  2. Spinnaker operate as an employment business in respect of any assignment or contract Spinnaker may find for you in relation to which you are or will be employed by Spinnaker and under the control of the hiring company. Unless you are an individual contractor or a limited company and the necessary legal requirements for the assignment to be regarded as a contract for services appear to be satisfied, Spinnaker will employ you in relation to the assignment under a contract of services.

  3. Spinnaker are required by law to obtain confirmation of your identity, that you are legally entitled and willing to work in the location and position which the hiring company is seeking to fill and that you have the experience, training, qualifications and any authorisations which the hiring company considers necessary or are required by law or by any professional body. You agree to provide the necessary information and documentation to Spinnaker in the fulfilment of these duties.

  4. When operating as an employment business, Spinnaker will not withhold payment to you if Spinnaker have not been paid by the hiring company. Spinnaker may only delay payment for a reasonable time to make inquiries if you have not produced a signed time sheet while Spinnaker obtain alternative proof that you have worked the hours claimed.

  5. Unless otherwise required by the hiring company, during the period of your employment with us, the notice period for each party is 1 week, the interval at which remuneration will be paid to you is monthly and you will be entitled to 20 days paid annual holiday or pro rata for your contracted hours and the duration of the assignment.

  6. When operating as an employment business Spinnaker will seek to obtain and to pay you a competitive rate of pay for any assignment Spinnaker find for you but in any event this will be not less than the legally required minimum.
